Regulations, Laws & Permits for Starting a Business in Stanislaus County
Whether you want to open a restaurant, start a salon, run a business from your home, or launch a food truck — the process follows a similar path. You need city approval and, for some businesses, county or state approvals too. This guide walks you through what to expect, who to call, and what to do first.
The most important thing you can do first:
Call your city's planning or economic development department before you sign a lease or buy equipment. This one phone call — which is free — can save you thousands of dollars and months of delays.
How Permitting Works
Every city in Stanislaus County has its own permitting process, its own staff, and its own systems. Modesto, Turlock, Ceres, Oakdale, Riverbank, Newman, Hughson, Patterson, and Waterford each handle business permits differently.
What they all share in common:
- You need a city business license to legally operate.
- If you are physically changing a space — new walls, plumbing, ventilation, kitchen equipment — you also need a building permit.
- Some business types require approval from the State of California, separate from anything the city handles.
- If you serve food in any form, you also need a permit from Stanislaus County Department of Environmental Resources (DER)— a completely separate process from the city.
A Business License Is Not Permission To Open
Getting your business license approved means the city confirmed your business type is allowed at that location. It does not mean you can open your doors. If your space needs remodeling, or if you serve food, there are additional steps. Read the relevant guide below.
Who handles what
Understanding which agency does what will save you a lot of confusion.

Before you sign a lease — do these first
The most common and costly mistake business owners make is committing to a space before checking whether it will work for their business type. These three steps are free and take minutes.
Check Zoning
Call the city's Planning Department with the address you are considering and ask: 'Is [your business type] allowed at this address?' This is free and takes 10 minutes
Check the building's fire inspection history
Ask your landlord when the building last had its 5-year fire inspection. If it is overdue, it can block your opening even after all permits are approved
Schedule a pre-application meeting
Most cities offer these for free. Bring your business idea and address. Staff will tell you exactly what permits you need, what fees to expect, and what surprises to watch for — before you spend any money

Common mistakes — and how to avoid them
Based on interviews with every city in Stanislaus County and with Stanislaus County Department of Environmental Resources.
Signing a lease before checking zoning
If your business type is not permitted in the zone you have chosen, you will face a months-long Conditional Use Permit process or the cost of finding a new space. Check zoning first. It is free and takes 10 minutes.
Thinking a business license means you can open
Your business license confirms you are allowed to operate that type of business at that location. If your space needs remodeling, sprinklers, ADA upgrades, or a change of occupancy, you also need a building permit and inspections before you can legally open.
Not knowing about the Stanislaus County Department of Environmental Resources until it's too late
If you serve food in any form, you need a Department of Environmental Resources (DER) Health permit — and it runs on a completely separate timeline from the city. Start your DER Health application at the same time as your city permits, not after. If you wait, you could have city approvals finished and still be waiting weeks for the county.
Submitting food facility plans without a consultant
County DER staff said it directly: knowing how to run a restaurant is not the same as knowing how to design one for code compliance. Every time plans are rejected and resubmitted, the 20-day review clock starts over. A consultant who has worked with Stanislaus County DER before can get your plans approved in one or two cycles. Ask DER for their free consultant list.
Missing the 5-year building fire inspection
Before you can open, the Fire Department checks whether your building is current on its 5-year inspection. This is the building owner's responsibility — not yours. If the building has been vacant and the inspection is overdue, it can block your opening even after all your other permits are complete. Ask your landlord before you sign: 'When was the last 5-year fire inspection?' Get the answer in writing.
Confusing your city license with your state professional license
If you are in cosmetology, contracting, childcare, or any other state-regulated trade, your California professional license is separate from your city business license. You need both. Your city license does not authorize you to practice a regulated profession.
Process Flow Diagrams
The diagrams below show the general permitting steps for the three most common business types across Stanislaus County. Steps shown side-by-side can happen at the same time — you do not have to wait for one to finish before starting the next. Dashed borders indicate optional or conditional steps.
Restaurant / Food Service
Most complex journey — involves both the city and a completely separate DER process. Both tracks should start at the same time.
Beauty Salon / Barber Shop
Simpler than a restaurant — no DER permit in most cases. The most common miss: the California cosmetology license is separate from the city business license. Both are required.
Home-Based
Fastest journey — typically 2–3 weeks. About 60–70% of all permit applicants in Modesto are home-based; the pattern holds across the county. Most skip both optional branches entirely.
